The parents of a man killed by Oakland police have filed a federal civil rights lawsuit against the city, saying their son was not armed when he was shot.

In their lawsuit filed Thursday in U.S. District Court in San Francisco, Adam and Jeralynn Blueford acknowledged that a witness saw their son trip and fall and that a "small black object," which turned out to be a gun, was 20 feet from him.
But Alan Blueford "did not make any move to retrieve that object," according to the suit filed by East Bay attorney John Burris. Moments later, Officer Miguel Masso caught up to him and shot him three times, the suit says.
"At the time of the shooting, the decedent was on his back, trying to get up," it adds. "He was unarmed when he was shot."
The lawsuit names the city, Police Chief Howard Jordan and Masso as defendants and seeks an unspecified amount in damages.
"The family has been traumatized by this," said Burris. "They believe their son, in fact, was murdered. I've filed this lawsuit now in order to get at the truth of what actually happened."
The complaint was filed on the same day Blueford's family lashed out at the department for withholding the police report in the case, which remains under investigation.
Sgt. Chris Bolton, Jordan's chief of staff, said police have "established lines of communication" with the family and would continue to release information as it becomes available.
The incident began when Masso and his partner saw Blueford and two companions on the 1900 block of 90th Avenue shortly after midnight. Blueford appeared to be hiding a gun, police said.
Blueford ran and twice pointed a gun at Masso, who responded with four shots, according to Masso's attorney, Harry Stern.
Three shots hit Blueford, and the fourth hit Masso in his leg, police said.
Several witnesses said they had seen Blueford point the gun, Bolton said.
A gun was recovered at the scene. Investigators do not believe it had been fired.
Blueford was nearing graduation from Skyline High School in Oakland. He had earlier been convicted of a burglary in San Joaquin County, police said.
